”How to challenge the decision of the authority or public institution where a person considers that their right of access to the requested information of public interest has been infringed
(refusal and failure to send within the legal term)
Where a person considers that their right of access to information of public interest has been infringed, they may submit an administrative complaint to the head of the public authority or institution from which the information was requested.
A person who considers that their rights have been infringed may lodge the administrative complaint provided for in within 30 days of becoming aware of the explicit or tacit refusal of the employees of the public authority or institution.
An applicant who, after receiving the reply to the administrative complaint, still considers that their rights under the law have been infringed may lodge a complaint with the administrative litigation division of the tribunal, within 30 days of the expiry of the time limits laid down in Law No. 544/2001.”
